These Terms and Conditions ("Terms") govern your access to and use of the LifeTab website (https://lifetab.co) and browser extension (the "Service"), operated by Sam Barton, a sole trader based in Australia ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By using LifeTab, you confirm that you have read, understood, and agree to these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use the Service.

2. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by updating the date at the top. Continued use of the Service after changes constitutes acceptance.

3. Access and Use

  1. Licence. We grant you a limited, non‐exclusive, non‐transferable licence to access and use the Service for your personal or business purposes, subject to these Terms.

  2. Eligibility. You must be at least 18 years old or have permission from a guardian to use the Service.

  3. Restrictions. You must not:

    • Reverse engineer, decompile or tamper with the Service;

    • Use the Service for illegal or unauthorised purposes;

    • Circumvent any security measures.

4. Accounts and Billing

  1. Registration. You may be required to register for an account and provide a valid email address.

  2. Billing. If you subscribe to any paid features, all payments are processed by Outseta. You are responsible for providing accurate billing information and paying all fees.

  3. Cancellation. You may cancel a subscription at any time through your account settings. Cancellations become effective at the end of the current billing period.

  4. Free Trial. New users are eligible for a one-time free trial period of 7 days, providing access to all Service features. After the trial ends, your subscription will automatically convert to a paid plan unless cancelled before the trial expires.

  5. Refunds. We offer a 30-day money-back guarantee. If you are not satisfied with the Service, you may request a refund within 30 days of your initial purchase by contacting our support team.

5. User Obligations

  1. You are responsible for keeping your account credentials secure.

  2. You must not submit content that is unlawful, defamatory, or infringes any third-party rights.

  3. We do not claim any ownership rights in your user-generated content; you retain all rights. We process your content solely to provide the Service.

6. Intellectual Property

All intellectual property rights in the Service, including trademarks, logos, and software, are owned by us or our licensors. Nothing in these Terms grants you any rights in our intellectual property beyond the licence granted above.

7. Third‑Party Services

The Service integrates with third-party providers such as OpenAI, Google Analytics, PostHog, Heap Analytics, and Outseta. Your use of such services is subject to their terms and privacy policies, and we are not responsible for their actions or omissions.

8. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind. We disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non‑infringement.

9. Limitation of Liability

To the maximum extent permitted by law, our liability for any claim arising out of or relating to the Service is limited to the amount paid by you in the 6 months preceding the claim. We are not liable for indirect, incidental, or consequential damages.

10. Termination

10.1 We may suspend or terminate your access to the Service at our discretion, without notice, if:

  • You fail to pay any fees when due.

  • You use the AI assistant in a manner that is abusive, illegal, or otherwise unreasonable.

  • You violate these Terms.

10.2 Upon termination, your licences and rights under these Terms will cease immediately.

11. Governing Law

These Terms are governed by the laws of New South Wales, Australia. Any dispute shall be subject to the exclusive jurisdiction of the courts of New South Wales.

12. Support

If you need assistance, you may contact our support team by email. We aim to respond within 48 hours. While we do not guarantee uptime or performance levels, we will endeavour to keep the Service available.

13. Communications

We may send you marketing and product update emails. You can opt out of these communications at any time by following the unsubscribe link in the email or contacting us.
